ABUSING SITE/SERVICE

Secret Madison works hard to keep its communities safe. Secret Madison reserves the right, at its discretion, without notice and at any time, to take the following action:

Refuse or delete Content which it feels is inappropriate and/or breaches the above terms, and/or goes against either the letter or spirit of the Terms of Use;

Your Account will be terminated if, in Secret Madison 's reasonable opinion, you are determined to be a repeat infringe, or otherwise have been the subject of more than one valid takedown request which has not been successfully rebutted.

You agree that Secret Madison may be required by law to access, monitor, store or copy material uploaded to the Site or sent by, or to, Registered Users without further notice to you. You acknowledge that Secret Madison cooperates fully with investigations into violations of systems or network security, including cooperating with law enforcement authorities in investigating suspected criminal violations.

PRICES & PAYMENTS

Using Secret Madison is free for the most part, but there are some Services for which Users will be charged a fee. If you pay for a Service, you will be given the chance to review and accept terms that will be clearly disclosed at the time of purchase. Prices and availability of Services are posted on the Site and are subject to change without notice. We may amend or update prices at any time by posting new prices on the Site.

Payments may be made by credit or debit card. All credit/debit cardholders are subject to standard validation checks and authorisation by the card issuer to comply with international anti-money laundering regulations before releasing payment.

If your card issuer refuses to authorise payment, your order will be cancelled. Secret Madison will not be held liable for the cancellation, and/or for any related fee incurred, and we are not obliged to inform you of the reason for the refusal. By using your credit or debit card, you confirm that the card is yours and that there are sufficient funds or credit available to cover the charges. Customers that issue charge backs will be liable for the fees levied against the Site at the banks prevailing rate, currently: 25 USD per charge back (MasterCard and VISA) plus a further 12 EUR for each VISA charge back or 15 EUR for each MasterCard charge back.

You are not permitted to use the Site to send or receive payment for any kind of physical meeting. This means that you must not use credits for any purpose other than which it was designed. REFUND & CANCELLATIONS

Credits. Purchase of credits if voluntarily. Credits have no monetary value and unused balances may not be redeemed for cash and cannot be refunded, except if it is required by applicable law. Unused balances will never expire.

Subscriptions: Subscriptions can be cancelled by the advertiser at any time and the advertiser will not be billed from the next billing cycle.

The Advertiser agrees that if the Advertiser is found, in the opinion of Secret Madisson acting reasonably, to:

- be using the photos or advertising material of another person as their own; or
- be sending another person in their place for any appointment; or
- be using the Website to refer Users to any other advertising directory, dating website or any other website (except the client's own personal website); or
- be using photographs, information and material not owned by them or which in Secret Madison's opinion a third party has expressed a right over such photographs, information and material; or
- have an interest in another website, business or venture that competes with the Website, the Secret Madison Services or Secret Madison; or
- have breached any of these terms and conditions,

the Advertiser's subscription may, in Secret Madison's absolute and unfettered discretion (in addition to all other rights and remedies open to it), be cancelled without refund (except as required at law) and the Advertiser's profile will be immediately removed from the Website.

COPYRIGHT & OTHER INTELLECTUAL PROPERTY RIGHT

You retain ownership of the rights you hold in your uploaded Content. You warrant that all Content uploaded by you, either from your own computer or another site/server, is created and owned entirely by you or you have the necessary licenses, rights and permissions to use the Content.

When you upload Content to the Site you grant to Secret Madison a worldwide, perpetual, non-exclusive license to it, or any form of it, in any media, the extent necessary to provide the Services and for Secret Madison 's own promotional purposes.

If you are not the creator of the whole of the Content then you must first get permission from the creator or the copyright holder before uploading the Content to the Site. GENERAL

Ads, Profiles or Accounts Seeking Services

Ads seeking escort services will not be accepted
Ads seeking adult work will not be accepted

Users must:

Ensure that all material and services are legal to sell/buy in the UK.
Register one account only. Users found with more than one profile will be subject to whatever action deemed fit by Secret Madison , including having their profile(s) suspended and/or deleted. This excludes couples who may advertise singly and as a couple, although their profiles must mention their other profile.
Make clear where a phone number charges premium rates.
Upload genuine photos only, which must be of true likeness of the Material(s) or Service(s) being advertised or sought. Any fake photos identified will result in the removal of the advert from the Site.

Users must not:

Post ads if under the age of 18.
Include a phone number, email address or website in the ad title, the ad profile, the photo or message.
Place duplicate ads in more than one category.
Propose the sale or purchase of multiple Materials or Services in the same advert that are not related.
Place adverts in the incorrect category or subcategory. All adverts of adult or sexual nature have to be posted within any of the available 18+ categories. This includes sale of lingerie.
Post any fake photos. Secret Madison reserves the right to request identification for verification. Should we find abuse of features available on the site, Secret Madison has the right to take action.
Post ads that are too short or ambiguous (this could result in an ad being classified as spam).
Post an ad for a Material or Service which is regulated or prohibited by law.
Use the details (name, phone number, mailing address, email, photos, etc.) of someone else without their permission or provide false contact details.
Reveal elements of a private nature or which violate the privacy of any person or company (including the publication of faces or signatures).

Promote a website or include any links on your ad (unless you have paid for the advert).
Promote or advertise gifts, sweepstakes or other prizes.
Make remarks that are false, defamatory, profane, hateful, abusive, pornographic, obscene or of any inappropriate nature (left to our discretion).
Post Ads which include non UK-based phone numbers.
Post any link (or any invitation to use a search engine to find this link) to any third party, including another website, blog, dating site or dating service.
Post ads which offer services that comprise, promote, insinuate or glorifies human trafficking or any other type of illegal sex work.

MODERATION OF ADS & ACCOUNTS

Secret Madison will remove any advertisement that is prohibited by UK law, placed in the wrong category/city or that contains vulgar/abusive content. Members of the site are encouraged to flag ads that break our terms and conditions and actively report all scams to Secret Madison or directly to Action Fraud, the UK's national fraud reporting centre.

YOUR PRIVACY

To minimize the risks of spam, all e-mails exchanged between users are done so anonymously through our server. In light of Secret Madison obligation to report on measures to ensure that all parts of our business and supply chain are slavery free, Secret Madison has put in place a designated modern slavery and human trafficking policy (this Prohibited Use Policy) and, Secret Madison has reviewed its workplace policies and procedures to assess their effectiveness in identifying and tackling modern slavery issues.

This Prohibited Use Policy and our workplace policies and procedures demonstrate our commitment to acting ethically and with integrity in all our business relationships and to implementing and enforcing effective systems and controls to ensure slavery and human trafficking is not taking place anywhere in our supply chains.

Due diligence processes for slavery and human trafficking

As part of our initiative to identify and mitigate human rights abuse, Secret Madison employs ‘moderators’, which comprise sophisticated technologies that are extremely efficient and are then checked by human moderators.

All incidents that are questionable are reported to senior administrators that have the experience and powers to escalate such incidents to official enforcement authorities.

We have in place systems to:
•    Identify and assess potential abuse areas.
•    Mitigate the risk of slavery and human trafficking occurring.
•    Monitor potential risk areas.
•    Protect whistle blowers.

Supplier adherence to our values

We have zero tolerance to slavery and human trafficking. To ensure all those in our supply chain and contractors comply with our values we have in place a supply chain compliance programme.

•    All Secret Madison customers have the option to remain anonymous and be categorised as highest risk to Secret Madison advertisers.
•    Customers that have validated identity have demonstrated transparency and trust becomes a matter for adults to measure (Secret Madison cannot endorse either).

Secret Madison reserves the right to verify all identities, advertiser or customer, via all available and legal means, which may include criminal and financial histories that are in the public domain.

Secret Madison does not engage in adult services directly.

Secret Madison provides the tools and/or mechanisms for adults to engage with each other, via group or individual communications, including broadcasting of text, pictures and videos, including broadcast and purchase of public or private performances, and we enable sale and purchase of items that members may, at their choice, wish to sell or buy.

INDEMNITY

You agree to indemnify and hold Secret Madison , its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of Content you submit, post or make available through the Service, your use of the Service, your violation of the Terms, your breach of any of the representations and warranties herein, or your violation of any rights of another.

CONTENT PROVIDER WITHDRAWALS

The amount to be withdrawn will be subject to an operating administration fee of 20 to 50% - depending on account level. The service fee is charged exclusive of tax. Tax charges on the service fee, if any, will be shown during the withdrawal/transfer process in accordance with the applicable laws.

No tax of any kind is taken or charged on the net amount of funds you receive from the site. The amount and type of tax due will be specific to each member and members are encouraged to seek the appropriate advice from a tax professional.

The operating administration fee helps us keep many features of this website free and we retain the right to change the percentage charge at any time without prior notice.

The Site does not charge or include sales tax in the purchase of Credits.

Secret Madison reserve the right to ask for any necessary identification as required by their payment processing partners to comply with international anti money laundering regulations before releasing payment.

Credits can be transferred to UK & EU bank accounts, (that participate in IBAN and will be conducted in Euros), once a minimum level of 150 credits has been accrued. If your bank account is eligible then the required BIC and IBAN numbers will be printed on your bank statement. Credits can be transferred to Payoneer or Paytoo accounts, (where payments are conducted in USD), once a minimum level of 30 Credits has been accrued. These thresholds apply for independent members. Whilst we endeavour to maintain as many payment options as possible (e.g. bank transfer, prepayment debit/credit cards and others), we cannot be held responsible for the operation or availability of these systems and your ability to withdraw or use your funds once transferred to them. You accept the risks associated with each processing method when you specify your desired method of transfer.
